Every officer who makes arrests, conducts searches of any kind, or detains anyone for the purposes of questioning them, must thoroughly understand the parameters set forth by the Fourth Amendment related to search and seizure. A lack of that understanding gravely jeopardizes cases and exposes you and your department to expensive legal liability and ultimately give criminals an avoidable and undeserved ticket to freedom.
This course is designed to give law enforcement professionals of all ranks a complete understanding of the Constitutional parameters that apply to search and seizure; the protections due citizens and the leeway officers have while performing their duties.
Among other topics, Detective Mike Montgomery, a detective with the West Chicago Police Department, will approach—in an extremely practical and understandable fashion—topics like:
- Citizens’ reasonable expectation of privacy.
- Non-physical and physical intrusions.
- Legal requirements to launch an investigation, execute arrests or conduct searches.
- What constitutes reasonable, articulable suspicion and probable cause.
- Handling drivers and passengers during traffic stops.
- Legally extending stops for the purpose of investigation.
- Plain view, plain smell and K9 sniffs.
- Pat downs, frisks and plain feel…and much more.
This course is both crucial and immediately applicable. No officer can afford to miss this information, and no agency can have officers who don’t fully understand the Fourth Amendment!
